Introduction

The website "www.immoscoop.be" ("Website") is operated by Immoscoop 2.0 BV ("Immoscoop") whose registered office is located at 3018 Wijgmaal, Vaartdijk 3 bus 201. Immoscoop is registered with the Crossroads Bank for Enterprises under the number 0770.397.655. Please read these conditions of use (''Conditions'') carefully before using our website. In this statement, we refer to 'user'. This term should be interpreted broadly and refers to any natural person or legal entity who consults, uses and downloads files from the Website or its content, Immoscoop reserves the right to modify these Terms of Use at any time. These modifications are immediately applicable. It is recommended to regularly consult the latest version of the conditions of use.


Use of the website

As a user of the website, you must act and behave in all respects as is expected of a responsible and careful Internet user.

For example, the following actions and behaviour are not permitted:

  • Infringing the intellectual property rights of Immoscoop and/or third parties;

  • Making derogatory, unlawful or misleading statements;

  • Distributing legally prohibited material;

In case Immoscoop nevertheless establishes infringements, the user undertakes to immediately discontinue them upon simple request by Immoscoop. Immoscoop reserves the right to recover the resulting damages from the user.

Availability

Immoscoop endeavours to make the website available 7 days a week and 24 hours a day. However, access to the site may be interrupted for certain technical or other reasons. Immoscoop reserves the right to terminate its services without being held responsible for these interruptions and their possible consequences for users or third parties.

Immoscoop makes every effort to ensure that the Website is free of bugs, viruses and unauthorised spyware. However, it cannot be excluded that these may be present. Under no circumstances can Immoscoop be held liable for any damage and/or loss resulting from this for the user. Immoscoop strongly recommends that users install a firewall, an anti-virus programme or other necessary security programmes on their computers.

Links to other sites

The Website may contain hyperlinks to third-party content or websites managed by third parties. Immoscoop cannot be held liable for the content of these websites, nor for the (content of the) services and/or information of third parties, offered in a similar way through its website. Nor can Immoscoop be considered as an authority which approves, publishes or authorises these websites or their content in general. The operators of these websites may be held solely responsible for compliance with the laws and regulations relating to the products and services they offer for sale on their website.

Liability

Immoscoop cannot be held liable for:

  • any decision or action taken by the user on the basis of the information or notices provided through the Website, nor for any errors or mistakes thereof.

  • damages arising from or in connection with the use of its Website nor the impossibility of using it.

  • the accuracy, completeness, suitability of the classified ads, the information on the Website and keeping it virus-free. If you have any doubts about the correctness of certain data or if you notice any problems or defects in the add, Immoscoop advises you to contact the seller concerned.

  • the non-performance, temporarily or permanently, of its obligations when this non-performance is the result of a case of force majeure or a fortuitous event.

  • any damages resulting from the use of electronic means of communication with the Website, including - but not limited to - damages resulting from non-delivery or delay in delivery of electronic messages, interception or manipulation of electronic messages by third parties or by software/equipment used for electronic communication and transmission of viruses.


Intellectual Rights

The content of the Website belongs to the intellectual property of Immoscoop 2.0 BV. It is protected by intellectual property law. The content is understood broadly and includes the texts, graphics, logos, buttons, images, code, database and icons.

Intellectual property rights include all copyright, patent rights, trademark rights, trade name rights, database rights, design rights, domain names, and other intellectual property rights in Belgium or elsewhere.

The design of the Website (plan, choice and arrangement of sections, organisation of data,...) is also covered by copyright. Immoscoop may prohibit the use of a part of a text, the entire Website or qualitatively or quantitatively substantial pieces, and possibly take legal action.

The user may print out a copy of the content displayed on the Website solely for personal use, provided that he does not modify the content of the Website in any way and that he retains all indications of authorship and origin of the site. Under no circumstances can Immoscoop be held responsible towards users of the Website for complaints or legal actions brought against them by a third party who would claim that the use of any element of the Website content or any of the products or services offered by the Website would infringe any of its intellectual rights.

The above conditions and the relations between Immoscoop and the users of Website are governed exclusively by Belgian law.
